Accelerated Patent Examination Cooperation Between TÜRKPATENT and CNIPA

On September 12, 2024, the Turkish Patent and Trademark Office (TÜRKPATENT) and the China National Intellectual Property Administration (CNIPA) signed a Letter of Intent for Cooperation on Accelerated Patent Examination.

Under this Letter of Intent, CNIPA will provide accelerated examination for Chinese applications entering the national phase in China, including those filed under the Patent Cooperation Treaty (PCT), where TÜRKPATENT was the first filing office. This initiative is part of the Belt and Road Intellectual Property Cooperation (BRIPC) Pilot Program.

BRIPC Pilot Program Overview

The core concept of the BRIPC Pilot Program is that when TÜRKPATENT determines that one or more claims of a patent application are patentable/acceptable, the applicant may request CNIPA to conduct an accelerated examination for the corresponding Chinese application. CNIPA will expedite the examination process for eligible applications.

The maximum number of applications under this program from TÜRKPATENT will be limited to 100 per year.

Required Documents for Applicants

Applicants must submit the following documents directly to CNIPA:

  • Copies of all notifications issued by TÜRKPATENT regarding the patentability of the application, along with their Chinese or English translations (machine translations are acceptable).
  • Copies of all claims determined as patentable/acceptable by TÜRKPATENT, along with their Chinese or English translations.
  • Copies of references cited by TÜRKPATENT examiners.

If the applicant has already submitted documents (a) to (c) to CNIPA through previous procedures, they may reference them instead of resubmitting.
