These are sui generis rights and called as plant variety rights
(abbreviated PVR
) or plant breeders rights
(abbreviated PBR
) for the protection of new varieties of plants.
The PBR provides protection for new plant varieties which are distinctive, uniform and stable following repeated propagation (so-called DUS
requirements). To obtain protection in Turkey, plant varieties should not be commercialised within Turkey more than one year prior to filing your application, or outside Turkey more than four years prior to filing (six years for a tree or vine species).
PBR is granted for a maximum term of 20 years, with the exception of 25 years for trees and vines, from the date of grant of the right. After grant, they should be renewed at the beginning of each protection year.
In Turkey, the applications for plant variety rights are processed and registered by General Directorate of Plant Production (BÜGEM
) and technically examined by Variety Registration and Seed Certification Center (TTSMO
).
