Turkish Industrial Property Code

Turkish Industrial Property Code is the principal legislation governing industrial property rights in Türkiye. Enacted on December 22, 2016, and entered into force on January 10, 2017., the Code consolidates and modernizes the legal framework for the protection of patents, trademarks, industrial designs, geographical indications, and other related rights.

The Code aligns Türkiye’s industrial property system with international agreements and European Union standards. It introduces comprehensive rules on application procedures, examination, opposition, enforcement, and invalidation of rights. It also strengthens legal certainty and provides more efficient administrative and judicial processes.

Under the Code, applications are handled by the Turkish Patent and Trademark Office, while disputes such as infringement and invalidity are adjudicated by specialized IP courts. The legislation also includes provisions on employee inventions, compulsory licensing, and protection of well-known trademarks.

The Turkish Industrial Property Code plays a central role in promoting innovation, protecting rights holders, and supporting economic development by ensuring an effective and modern IP system in Türkiye.
