Supplementary Protection Certificate is a sui generis intellectual property right that extends the protection period of certain patented pharmaceutical and plant protection products after the expiration of the underlying patent. The purpose of the SPC system is to compensate patent holders for the time lost while obtaining mandatory regulatory marketing approvals.
SPCs are available in many European jurisdictions and are governed by specific legislation separate from ordinary patent law. To qualify for an SPC, the product must generally be protected by a valid patent and have received a valid authorization to be placed on the market. The duration of protection is calculated according to statutory rules and may extend exclusivity for up to five years beyond the normal patent term.
Within the European Union, SPCs play a particularly important role in the pharmaceutical and agrochemical sectors, where regulatory approval processes can significantly reduce the effective commercial life of patented products. Additional extensions may be available in certain cases involving pediatric medicines.
