International Preliminary Examining Authority (IPEA) is a designated authority under the Patent Cooperation Treaty responsible for conducting the optional international preliminary examination of patent applications. This stage allows applicants to obtain a more detailed assessment of their invention before entering national or regional phases.
During this procedure, the IPEA evaluates whether the invention appears to meet key patentability criteria such as novelty, inventive step, and industrial applicability. The result is issued in the form of an International Preliminary Report on Patentability (IPRP), which provides valuable guidance to applicants and patent offices.
Applicants may use this process to amend claims, refine their applications, and address objections raised during the earlier international search phase. Although the opinion of the IPEA is not binding on national patent offices, it is highly influential in subsequent examination procedures.
IPEAs are typically major patent offices, such as the European Patent Office and Japan Patent Office, which have been appointed to perform this function under the PCT system.
