European patent validation

European patent validation refers to the post-grant procedure required to make a European patent effective in individual designated countries. After a patent is granted by the European Patent Office, it must be validated separately in each country where protection is sought.

Validation typically involves fulfilling national requirements, which may include filing translations of the patent, appointing local representatives, and paying validation or publication fees. These requirements vary depending on the country and applicable international agreements, such as the London Agreement, which may reduce translation obligations in certain states.

Once validated, the European patent takes effect as a national patent in each selected country, subject to national laws on enforcement, renewal fees, and litigation. Failure to complete validation requirements within the prescribed deadlines results in the loss of protection in that jurisdiction.

European patent validation is a crucial step in securing effective patent protection across Europe, ensuring that granted rights are enforceable at the national level.
