design patent

Design patent refers to a form of intellectual property protection granted for the ornamental or aesthetic appearance of a product. Design patents protect visual features such as shape, configuration, surface ornamentation, and overall appearance rather than the technical function of an invention.

The scope and terminology of design protection vary between jurisdictions. In the United States, the term “design patent” is commonly used and protection is granted by the United States Patent and Trademark Office. In many other jurisdictions, including Türkiye and the European Union, equivalent protection is generally provided through registered industrial design systems rather than patent law terminology.

To qualify for protection, a design typically must be new and possess individual character or originality. Design protection gives the owner exclusive rights to prevent unauthorized copying, manufacture, sale, or commercial use of substantially similar designs.

Design patents and industrial design registrations play an important role in protecting product appearance, branding, consumer appeal, and commercial differentiation across industries such as fashion, consumer electronics, automotive products, packaging, and furniture.
