GCC Patent System and the GCC Patent Office

The Gulf Cooperation Council Patent System (GCC Patent System) is a regional patent framework established to provide patent protection across member states of the Gulf region.

The system operates under the umbrella of the Gulf Cooperation Council (GCC), with applications administered through the GCC Patent Office (GCCPO).

Under the traditional GCC patent system, which was implemented in 1998, applicants could obtain regional patent protection effective throughout all GCC member states through a single patent application.

However, the GCC Patent System underwent significant structural reforms, particularly after 2021. Today, the GCC Patent Office no longer functions as a unitary regional patent system granting a single GCC patent in the traditional sense.


Structure of the GCC Patent System

The GCC system:

  • Is based on a regional patent cooperation model
  • Includes centralized filing and examination mechanisms
  • Relies largely on national laws for patent enforcement
  • Uses Arabic as its official working language
  • May require Arabic translations of foreign-language documents

Note: The GCC system only provides patent protection. There is currently no regional trademark or industrial design system within the GCC framework.

Changes to the GCC Patent System After 2021

Pursuant to a decision adopted during the 41st session of the GCC Supreme Council held in Al-Ula on 5 January 2021, the traditional unified GCC patent system was substantially restructured.

As of 6 January 2021, the GCC Patent Office:

  • Ceased accepting unified patent applications that automatically produced legal effect across all GCC member states
  • Began assuming a role focused primarily on centralized examination and technical support services

As a result:

  • A single “GCC patent” is no longer available by default
  • Patent rights are now primarily granted as national patents
  • GCCPO operates largely as a regional examination and coordination authority

Legacy GCC Patent Applications

GCC patent applications filed before 5 January 2021 continue to be processed.

Patents granted under these earlier applications may continue to enjoy regional effect across the six GCC member states under the former system.

Practical Note: Significant legal and procedural differences exist between legacy GCC patents and applications filed under the current framework.


The New GCCPO Examination Model

Under the new framework implemented from 2022 onward, the GCC Patent Office functions less as a patent-granting authority and more as a regional examination body conducting patent examinations on behalf of certain GCC member states.

Under the new model:

  • Applications may be examined by GCCPO on behalf of participating national offices
  • Following examination, files are transferred to the relevant national patent offices
  • Patent grant or refusal decisions are issued by the respective national authorities

This framework is commonly referred to as the “outsourced examination model.”


States Actively Using the GCCPO Examination System

As of 2025, the GCCPO’s centralized examination model is actively used by:

  • Bahrain
  • Kuwait
  • Qatar

Saudi Arabia, the United Arab Emirates, and Oman continue to conduct patent procedures primarily through their own national patent offices.


Filing Strategies and Protection Structure

Today, applicants seeking comprehensive patent protection throughout the GCC region typically adopt a hybrid strategy.

1. GCCPO-Supported Filings

For Bahrain, Kuwait, and Qatar:

  • A single filing may be used for a multi-country examination process
  • Examination is conducted centrally by GCCPO
  • Separate national patents are ultimately granted

2. National Filings

For Saudi Arabia, the UAE, and Oman, applications are generally filed directly with the respective national patent offices.

Accordingly, the current GCC framework:

  • Has moved away from the traditional unitary patent model
  • Has evolved into a hybrid regional-national system

GCC System and International Filing Systems

The GCC Patent Office itself is not a contracting party to the Patent Cooperation Treaty (PCT).

Consequently, there is no direct GCC regional phase available under the PCT system.

However, all GCC member states are individually parties to both the Paris Convention and the PCT.

Therefore, applicants may:

  • Claim the 12-month Paris Convention priority right
  • Enter the national phase in GCC member states through the PCT system

Note: In practice, GCCPO procedures are conducted in a manner generally consistent with many international patent examination standards and WIPO guidelines.
