New practice for search and examination requests announced by TURKPATENT

Turkish Patent and Trademark Office (TURKPATENT) announced on January 02, 2019 that search and examination requests will be able to be filed simultaneously to accelerate patent application processes and thus provide better quality services for the applicants.

The applicants can request both search and examination at the same time , or can opt for each one separately, on their own preferences.

In the case that the applicants file the request for both search and examination at the same time, the examination report will issued according to the following instances:

• The examination report will be issued and sent to the applicant together with the search report if the search report is positive.
• The search report will be issued and sent only if the search report is negative and the examination process will be automatically started after the period of 3 months calculated as from the receipt of the notification of the search report is expired.

This new practice is expected to substantively expedite the patenting process in Turkey.
