Overview

Iraq joined the Patent Cooperation Treaty (PCT) on 31 January 2022.

The treaty entered into force in Iraq on 30 April 2022.

With Iraq’s accession, the number of PCT contracting states increased to 155.

Impact of Iraq’s Accession

Starting from 30 April 2022:

  • Iraqi applicants became able to file international patent applications under the PCT system
  • Foreign applicants became able to designate Iraq in PCT applications for patent protection

The accession expanded the geographical coverage of the international patent filing system and strengthened Iraq’s integration into the global intellectual property framework.

What Is the Patent Cooperation Treaty (PCT)?

The Patent Cooperation Treaty (PCT), administered by WIPO, provides a centralized system for filing international patent applications.

Instead of filing separate patent applications simultaneously in multiple jurisdictions, applicants may:

  • File a single international application
  • Designate multiple member countries
  • Obtain an international search and preliminary examination framework

The PCT does not itself grant an international patent. Rather, it simplifies and coordinates the international filing process before national phase entry.

Advantages of the PCT System

The PCT system offers several practical advantages:

  • Centralized filing procedure
  • Additional time before national filings
  • International prior art search
  • Preliminary assessment of patentability
  • Simplified management of multi-country patent filings

The system also assists patent offices during substantive examination procedures.

Significance for Iraq

With the PCT entering into force:

  • Iraqi inventors and companies gained easier access to international patent protection
  • Foreign businesses obtained a streamlined route for seeking patent protection in Iraq

The development is expected to facilitate international patent activity involving the Iraqi jurisdiction.

Conclusion

Iraq’s accession to the Patent Cooperation Treaty marked an important step in the country’s participation in the international patent system.

The accession allows both Iraqi and foreign applicants to use the PCT framework for international patent filings and expands the global reach of patent protection strategies involving Iraq.
